These Terms of Use ("Terms") govern your use of the Mintlog mobile application ("the app", "we", "our"). By downloading, installing, or using Mintlog, you agree to these Terms. If you do not agree, do not use the app.

1. Description of Service

Mintlog is an AI-powered idea journal that allows users to record voice notes and text entries, which are then analyzed by artificial intelligence to produce business insights, vision cards, follow-up chat, UI mockups, and weekly digests. The app is available on iOS with both free and paid subscription tiers.

2. Eligibility

You must be at least 13 years old to use Mintlog. By using the app, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent's or guardian's permission to use the app.

3. Account and Device Access

Mintlog does not require account creation. Access is tied to an anonymous device identifier generated on your device. You are responsible for maintaining the security of your device. We are not liable for any loss of data resulting from device loss, theft, or unauthorized access to your device.

4. Subscriptions and Payments

Free tier: Includes 3 AI analyses per month, follow-up chat on every insight (up to 5 messages per insight), 3 vision cards per month, and 1 free UI mockup.
Pro subscription: Unlocks unlimited AI analyses, unlimited chat, unlimited vision cards, unlimited mockups, and weekly digests. Available at $12.99/month or $59.99/year.
Billing: Subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase.
Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Cancellation: You can manage and cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
Refunds: All refund requests are handled by Apple in accordance with their refund policies.

5. Acceptable Use

You agree not to:

Use the app for any unlawful purpose or in violation of any applicable laws.
Submit content that is harmful, threatening, abusive, defamatory, or otherwise objectionable.
Attempt to gain unauthorized access to our servers, systems, or other users' data.
Use automated systems, bots, or scripts to access the app or its API.
Reverse engineer, decompile, or disassemble the app or its backend services.
Circumvent or attempt to circumvent usage limits, rate limits, or subscription restrictions.
Resell, redistribute, or sublicense the app or any content generated by it.

6. Your Content

Ownership: You retain ownership of the text and voice recordings you create in the app.
License: By submitting content to Mintlog, you grant us a limited, non-exclusive license to process your content through our AI services solely for the purpose of providing you with the app's features (analysis, insights, mockups, etc.). We do not use your content for training AI models.
Responsibility: You are solely responsible for the content you submit. We do not monitor or endorse user-submitted content.

7. AI-Generated Content

Nature of output: All insights, analyses, revenue models, pricing suggestions, market estimates, vision cards, mockups, and other AI-generated content are produced by artificial intelligence and are provided for informational and inspirational purposes only.
No guarantees: AI-generated content does not constitute professional business, financial, legal, or investment advice. Market estimates, revenue projections, and impact scores are AI-generated approximations and should not be relied upon for business decisions without independent verification.
Accuracy: We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. AI models may produce incorrect, outdated, or misleading information.

8. Intellectual Property

The Mintlog app, its design, code, branding, and all associated intellectual property are owned by us. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements without prior written permission.

9. Disclaimer of Warranties

MINTLOG IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We reserve the right to suspend or terminate your access to the app at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the app ceases immediately.

12. Changes to These Terms

We may modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the app after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
